1. Acceptance of Terms

By downloading, installing, or using the assclapp mobile application ("App") or website (asscl.app) provided by GRITNESS UG (haftungsbeschränkt), Am Hohen Stein 25, 01189 Dresden, Germany ("we", "us", or "our"), you agree to be bound by these Terms and Conditions.

If you do not agree with any part of these Terms, do not download or use the App.

2. Description of Service

assclapp is a challenge app that helps you build habits by joining, tracking, and completing fitness and lifestyle challenges together with other users. The App includes a free tier and a premium subscription ("assclapp Pro") that unlocks additional challenges and features.

We reserve the right to modify, suspend, or discontinue any part of the Service at any time with reasonable notice.

3. User Accounts & Eligibility

To use the App, you must create an account using your email address or via Apple Sign-In. You must be at least 16 years old to use assclapp.

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You must notify us immediately of any unauthorized use of your account at nice@asscl.app.

4. User Obligations

You agree not to:

• Use the App for any unlawful purpose or in violation of these Terms;
• Attempt to gain unauthorized access to any part of the App or its infrastructure;
• Interfere with or disrupt the App's servers, networks, or other users;
• Reverse engineer, decompile, or attempt to extract the source code of the App;
• Use automated tools to scrape, index, or collect data from the App;
• Impersonate any person or entity or misrepresent your affiliation.

5. User Content

The App lets you post comments, progress updates, and other content on challenges ("User Content"). You retain ownership of your User Content, but you grant us a non-exclusive, worldwide, royalty-free licence to host, display, and distribute it within the App for the purpose of operating the Service.

You are solely responsible for your User Content. You agree not to post content that is unlawful, abusive, harassing, or that infringes the rights of others. We may remove User Content or suspend accounts that violate these Terms.

6. Subscriptions & Payments

assclapp Pro is available as an in-app subscription managed through the Apple App Store or Google Play Store and processed via Adapty.

Subscription prices are displayed within the App at the time of purchase and may vary by region. Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current billing period. You can manage and cancel your subscription in your device's App Store or Google Play account settings.

We do not store or process payment card data. All payment transactions are handled exclusively by Apple or Google.

7. Intellectual Property

All content within the App and website, excluding User Content, including challenge data, design, graphics, and software, is the property of GRITNESS UG or its licensors and is protected by copyright, trademark, and other applicable laws.

You are granted a limited, non-exclusive, non-transferable licence to use the App for personal, non-commercial purposes. You may not copy, reproduce, distribute, or create derivative works from any part of the App without our explicit written consent.

8. Disclaimer of Warranties

The App is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not warrant that the App will be uninterrupted, error-free, or free of viruses or other harmful components.

The App is not a substitute for professional medical advice. Consult a physician before starting any fitness challenge, especially if you have a pre-existing medical condition. We make no representations regarding the suitability of any challenge for your individual health situation.

9. Limitation of Liability

To the fullest extent permitted by applicable law, GRITNESS UG shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the App, including any injury sustained while completing a challenge.

Our total liability to you for any claim arising from these Terms or your use of the App shall not exceed the total amount paid by you for assclapp Pro subscriptions in the 12 months immediately preceding the claim.

10. Termination & Account Deletion

We reserve the right to suspend or terminate your access to the App at any time if you violate these Terms or if required by law. Upon termination, your right to use the App ceases immediately.

You may delete your account at any time through the App's account settings. After deletion, your personal data will be retained for up to 30 days to allow for recovery, after which it will be permanently deleted.

11. Governing Law

These Terms are governed by the laws of the Federal Republic of Germany, excluding its conflict-of-law provisions. The United Nations Convention on Contracts for the International Sale of Goods (CISG) does not apply.

For disputes with merchants or persons without a general place of jurisdiction in Germany, the exclusive place of jurisdiction is Dresden, Germany.

12. Dispute Resolution & Changes to Terms

The European Commission provides an online dispute resolution (ODR) platform at https://ec.europa.eu/consumers/odr. We are not willing or obliged to participate in dispute resolution proceedings before a consumer arbitration board.

We reserve the right to modify these Terms at any time. We will notify you of material changes through the App or by email at least 14 days before they take effect. Continued use of the App after changes take effect constitutes your acceptance of the revised Terms.
